TERMS AND CONDITIONS OF THE ONLINE STORE SHOPOLLO.EU

I. General Provisions

  1. The online store operating at https://shopollo.eu (hereinafter referred to as the "Store") is operated by:

  1. These Terms and Conditions define the rules for using the Store, purchasing products, and the rights and obligations of the Seller and the Customer.

  2. The Store operates in accordance with EU legislation, in particular with Directive 2011/83/EU on consumer rights and Regulation (EU) 2016/679 (GDPR).

  3. The Store sells products to Customers located in the European Union.


II. Definitions

  1. Store – the online platform available at shopollo.eu through which Customers can purchase products.

  2. Customer – any natural person, legal person, or organisational unit without legal personality, making a purchase via the Store.

  3. Consumer – a Customer who is a natural person making a purchase not directly related to their trade, business or profession.

  4. Product – a tangible item offered for sale in the Store.

  5. Order – a Customer’s declaration of intent submitted electronically, aiming to conclude a sales contract.

  6. Terms and Conditions – this document governing the operation of the Store.


III. Ordering Process

  1. Orders may be placed 24/7 via the Store’s website.

  2. Prior to placing an order, the Customer must read and accept the Terms and Conditions.

  3. Orders are processed after full payment has been received.

  5. Estimated dispatch times:

    • 1–3 business days for in-stock products.
    • 2–10 business days for products not currently in stock.

IV. Prices and Payments

  1. Prices are quoted in EUR (gross, including VAT).

  2. Delivery costs are calculated separately during checkout.

  3. Accepted payment methods::

    • Bank transfer.
    • Online payments provided by authorized payment processors (PayU).
  4. Payment must be completed within 5 calendar days. Unpaid orders will be automatically cancelled.

  5. Orders are dispatched only after payment has been confirmed.

  6. In case of cancellation, overpayment, or return, refunds will be issued within 14 days to the original payment method.

  7. The Store does not offer:

    • Cash on delivery (COD).
    • In-person pickups
  8. The Store reserves the right to:

    • Cancel orders in the event of product unavailability, missing or incorrect payment, or incorrect delivery details.
    • Withhold refunds until the returned item is received or proof of return is provided.
  9. The Store is not liable for delays caused by payment providers or banks.


V. Delivery

  1. Products are delivered across the European countries.

  2. Delivery costs are specified during checkout and borne by the Customer.

  3. Delivery time is 1–5 business days from dispatch, depending on the carrier.

  4. Any damage must be reported within 5 days of delivery.

  5. Upon delivery, Customers should inspect packages and, if needed, prepare a damage report with the courier and take photographs.

  6. The Store is not liable for:

    • Delays caused by the carrier.
    • Loss or return of goods due to incorrect delivery information.
    • Additional shipping fees for redirected or reshipped parcels.
  7. In the case of delivery delays exceeding 30 days, the Customer may withdraw from the contract and request a refund.


VI. Right of Withdrawal (Consumers)

  1. Consumers have the right to withdraw from the contract within 14 days without stating a reason.

  2. To exercise the right, the Consumer should:

    • Fill in the withdrawal form available on the Store’s website, or
    • Send a clear withdrawal statement via email.
  3. The returned product must be sent back within 14 days of withdrawal.

  4. The Store will refund all payments within 14 days of receiving the returned product.

  5. Return shipping costs are borne by the Consumer unless the product is faulty or incorrect.


VII. Complaints and Warranty

  1. The Customer may file a complaint if the Product is defective or inconsistent with the contract.

  2. Complaints should be sent:

    • By post: TETAMAX Sp. z o.o., A. Mickiewicza 29, 40-085 Katowice, Poland
  3. The complaint should include:

    • Customer’s name and contact details,
    • Order number or proof of purchase,
    • Description of the defect or issue,
    • Customer’s request (e.g., repair, replacement, refund)
  4. The Store will respond to complaints within 14 calendar days. Lack of response means the complaint is accepted.

  5. If the complaint is accepted, the Store will:

    • Repair the product
    • Replace it with a new one, or
    • Refund the price.
  6. Consumers and “quasi-consumers” (sole proprietors making a purchase not related to their professional activity) may file complaints under statutory warranty rules for 2 years.

  7. If a defect is found within 12 months of delivery, it is presumed to have existed at delivery.

  8. Customers must return defective items at the Store’s expense for assessment.

  9. For business customers (not consumers or quasi-consumers), the warranty is excluded, in accordance with Article 558 §1 of the Polish Civil Code.

  10. If the Product is covered by a manufacturer’s guarantee, its terms shall apply.


VIII. Personal Data Protection

  1. The data controller is Tetamax Sp. z o.o.

  2. Personal data is processed for order fulfilment, customer support, and – with consent – marketing purposes.

  3. Customers have the right to:

    • Access, rectify or delete their data,
    • Limit or object to data processing,
    • Transfer their data.
  4. Personal data is stored for the time required to complete orders and in accordance with applicable legal obligations.

  5. Details are provided in the Store’s Privacy Policy.


IX. Final Provisions

  1. Contracts concluded via the Store are governed by EU and Polish law.

  2. Any disputes will be resolved by the court competent for the Seller’s registered office, unless EU consumer law provides otherwise.

  3. The Store reserves the right to amend the Terms and Conditions. Customers will be informed by email.

  4. These Terms and Conditions enter into force on 1 March 2025.

Appendix 2: Exceptions to the Right of Withdrawal

The right of withdrawal does not apply to contracts for:

  1. Services fully performed with prior Consumer consent.

  2. Sealed goods that were unsealed after delivery and cannot be returned for health or hygiene reasons.

  3. Goods made to the Consumer’s specifications or clearly personalized.

  4. Goods liable to deteriorate rapidly.
